Terms of Service

Introduction

These Terms of Service (“Terms”) govern your use of the DesignOnMenu website and the services we provide. By using our website, submitting a project enquiry, or engaging DesignOnMenu for services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or engage our services.

Our services

DesignOnMenu is a creative design and technology studio offering services including:

  • Brand design
  • Web design
  • Product design
  • Web development
  • Product development
  • Creative and visual design
  • Strategy and related design services

The specific services, deliverables, timeline, and fees for each client project will be defined in an individual proposal, statement of work, or project agreement.

Project engagements

Before work begins, DesignOnMenu and the client will agree on the project scope, deliverables, timeline, fees, and payment terms. We will use reasonable efforts to deliver the agreed work within the agreed timeframe. Project timelines may change where delays are caused by factors outside our reasonable control, including delayed feedback, missing content, delayed approvals, or changes to project requirements.

Client responsibilities

To keep a project moving, clients are responsible for providing information, content, feedback, approvals, and other materials reasonably required by DesignOnMenu. Delays in providing required materials or feedback may affect the project timeline.

Payments

Project fees and payment schedules will be agreed before work begins. Invoices must be paid according to the payment terms stated in the relevant project agreement. Where payments are overdue, DesignOnMenu may pause work until outstanding amounts have been settled. Additional work outside the agreed scope may require an additional fee.

Revisions and approvals

Each project will have a defined process for feedback and revisions. The number of revisions included in a project will depend on the scope agreed with the client. Once a deliverable has been approved, subsequent changes may be treated as additional work and may incur additional fees.

Intellectual property

Unless otherwise stated in the project agreement, DesignOnMenu retains ownership of its pre-existing materials, processes, systems, concepts, tools, and reusable resources. Upon full payment, the client receives the rights to use the final deliverables created specifically for their project according to the terms agreed in the project agreement. Third-party assets, software, fonts, stock imagery, plugins, and other licensed materials remain subject to their respective licence terms.

Portfolio and project usage

Unless otherwise agreed in writing, DesignOnMenu may display completed work created for a client in its portfolio, website, social media, presentations, case studies, and other promotional materials. Where a project is confidential or subject to a non-disclosure agreement, we will respect the applicable confidentiality requirements.

Confidentiality

Both DesignOnMenu and the client may receive confidential information during a project. Each party agrees to use reasonable care to protect confidential information and not disclose it to third parties except where necessary to perform the agreed services or where required by law.

Third-party services

Some projects may require third-party platforms, software, hosting providers, APIs, plugins, payment providers, fonts, or other services. Unless specifically agreed otherwise, DesignOnMenu is not responsible for changes, interruptions, pricing, availability, or failures caused by third-party services.

Termination

Either party may terminate a project in accordance with the cancellation terms and the individual project agreement. Termination does not remove the obligation to pay for work already completed or approved expenses incurred before termination.

Changes to these Terms

We may update these Terms from time to time. Any changes will be published on this page.
